DA VANCE: CLEMENTE RIVERA SENTENCED TO 25 YEARS IN STATE PRISON FOR 2013 ATTACK ON ELDERLY WOMAN

Manhattan District Attorney Cyrus R. Vance, Jr., today announced the sentencing of CLEMENTE RIVERA, 46, to 25 years in state prison for the 2013 attack and robbery of an elderly woman. On July 22, 2015, a New York State Supreme Court jury found RIVERA guilty of Burglary in the First Degree, Robbery in the Second Degree, and Assault in the Second Degree. 

“Older New Yorkers are some of the most vulnerable in our City and are all too often the victims of crimes of opportunity,” said District Attorney Vance. “In this case, Clemente Rivera violently robbed an 84-year-old woman as she was entering her home. Thanks to the work of my Office’s prosecutors and Judge Fitzgerald, this defendant will serve significant prison time for this senseless crime.”

As proven at trial, at approximately 11 a.m. on July 21, 2013, RIVERA held the door for an 84-year-old woman as she entered her apartment building in the Alfred E. Smith Houses on Catherine Slip in Lower Manhattan. He followed her to her apartment, forced his way inside as she was opening the door, and knocked her onto the ground. While the victim was on the ground, RIVERA stole approximately $40 and other property from her apartment and fled the scene. 

After the attack, the NYPD released a poster using images from the apartment building’s surveillance cameras. Multiple sources identified RIVERA as the attacker. He was apprehended five days later and placed under arrest at a homeless shelter. 

Assistant District Attorney Shawn McMahon handled the prosecution of the case under the supervision of Assistant District Attorney Warren Murray, Chief of Trial Bureau 50, and Executive Assistant District Attorney John Irwin, Chief of the Trial Division. 

District Attorney Vance thanked members of the NYPD, including Officer Sean Carroll of Police Service Area 4 and Detective Antonio Mok of the Manhattan Robbery Squad.
