Manhattan District Attorney Alvin L. Bragg Jr. today announced the indictment of FELIX ROJAS, 44, for allegedly attempting to rape a physically helpless man on a Manhattan-bound R train during the late night of April 8, 2025, into the morning of April 9, 2025. ROJAS is charged in a New York State Supreme Court indictment with two counts of Attempted Rape in the First Degree, one count of Sexual Misconduct, and one count of Attempted Grand Larceny in the Fourth Degree. “Felix Rojas allegedly sexually assaulted a completely physically helpless man on the subway. This conduct is egregious, and we will prosecute this case to the fullest extent,” said District Attorney Bragg. “While transit crime is down, I want New Yorkers to know that we are continuing to work with our law enforcement partners make our bustling subway system safe. My thoughts are with Jorge Gonzalez’s loved ones who are continuing to mourn his tragic loss.”
According to court documents and statements made on the record, a 37-year-old man entered a Manhattan-bound R subway car at in Brooklyn at approximately 7:52 p.m. on April 8, 2025, staying in the same spot for the next few hours. At approximately 10:46 p.m., the man smoked a cigarette and appeared to lose consciousness two minutes later.
At approximately 10:51 p.m., ROJAS entered the train car in Brooklyn and sat across from the motionless man at approximately 11:21 p.m. ROJAS allegedly approached him and started to search and touch the man’s body multiple times up until approximately 11:45 p.m., when the alleged sexual assault started.
ROJAS periodically stopped as the train would approach and stop at stations along the line between Queens and Manhattan. He sat down and stopped touching the man when passengers entered the train car.
ROJAS repeatedly allegedly sexually assaulted the victim until approximately 12:09 a.m., when he moved the victim onto the floor and allegedly continued to sexually assault the victim. At approximately 12:16 a.m., ROJAS searched the victim one last time, including taking off the victim’s shoes and searching them one by one.
An MTA worker found the victim at the Whitehall Station and called EMS where rescue medics pronounced the victim dead at the scene.
Assistant D.A.s Alexander Bourdakos (Trial Bureau 40) and Kaitlyn Flatley (Deputy Bureau Chief of Intimate Partner and Sexual Violence Bureau) are handling the prosecution of this case under the supervision of Executive Assistant D.A. Justin McNabney (Chief of the Special Victims Division). Investigative Analyst Katherine Burke is providing valuable assistance in this case.
