D.A. Bragg Announces Indictment Of Man For Attempted Murder Of Former Boss On The Upper West Side

Manhattan District Attorney Alvin L. Bragg, Jr., today announced the indictment of EDUARDO DIAZ, 42, for shooting a 47-year-old man, his former boss, on the Upper West Side in November 2024. DIAZ is charged in a New York State Supreme Court indictment with one count of each of Attempted Murder in the Second Degree, Attempted Assault in the First Degree and Assault in the Second Degree. He is additionally charged with two counts of Criminal Possession of a Weapon in the Second Degree. [1]

“As alleged, Eduardo Diaz brutally targeted, shot and seriously injured his former employer in a broad daylight attack on a busy city street,” said District Attorney Bragg. “This alleged conduct not only endangered the life of the victim, but also brazenly disregarded the safety of Manhattanites both in the community and surrounding area – causing rippling effects for many New Yorkers as Mr. Diaz fled into the subway system with a firearm. My Office will continue to work in tandem with our law enforcement partners to combat gun violence and I wish the victim a swift recovery.”  

According to court documents and statements made on the record in court, DIAZ was terminated from his job and threatened his former boss through a text message several months prior to the shooting.  

On November 7, 2024, at approximately 9:15 a.m., DIAZ went to his former workplace on the Upper West Side, near West 68th Street and Columbus Avenue. DIAZ approached and confronted his former boss. DIAZ took out a firearm and attempted to shoot the victim, but the gun jammed. A few minutes later, the confrontation continued outside onto the street, near West 69th Street and Columbus Avenue. DIAZ fired multiple shots at the victim, at close range, striking him in the ankle, hip and shoulder and causing him to fall to the ground. DIAZ continued to shoot at the victim while he was lying on the ground. The victim was eventually transported to Mount Sinai St. Luke’s Hospital and was held over several days for treatment.   

DIAZ fled the scene into the 72 Street subway station, near Central Park West, where he escaped through the tunnels. He was arrested on November 8, 2024, at a home in Queens. Officers executed a court-authorized search warrant of the home and recovered a firearm, ammunition and clothing DIAZ was allegedly seen wearing during the shooting.

Assistant D.A.s Patrick Nelligan and Sidney Balman III are handling the prosecution of this case, under the supervision of supervision of Assistant D.A.s Annie Siegel (Deputy Chief of Trial Bureau 60), Harrison Schweiloch (Deputy Chief of Trial Bureau 60), Charles Whitt (Chief of Trial Bureau 60), and Executive Assistant D.A. Lisa DelPizzo (Chief of the Trial Division). Trial Preparation Assistants Justin Maye (Trial Bureau 60) and Timothy Savastano (Trial Bureau 60) are providing valuable assistance.

D.A. Bragg thanked the NYPD, particularly Detective Christopher Latty of the 20th Precinct and Detective Christopher O’Connor of the NYPD Warrant Section.
