Manhattan District Attorney Alvin L. Bragg Jr. today announced the indictment of Kevin Crosby, 49, for allegedly driving while under the influence of drugs and crashing into two food delivery cyclists, killing Zacarias Darly and critically injuring the other cyclist, in Harlem in March 2026. CROSBY is charged in a New York State Supreme Court indictment with one count each of Aggravated Vehicular Homicide, Manslaughter in the Second Degree, Criminal Possession of a Controlled Substance in the Seventh Degree, Operating a Motor Vehicle While Under the Influence of Drugs, and Reckless Driving. “Two New Yorkers were riding their bikes to deliver food when they were struck by an SUV moving at an extremely high rate of speed. As alleged, Kevin Crosby’s fatal conduct cut Zacarias Darly’s life short, and critically injured the second cyclist,” said District Attorney Bragg. “Our streets should be safe for cyclists, and we will prosecute drivers whose dangerous driving harms New Yorkers. My thoughts are with Mr. Darly’s loved ones who are mourning his loss, as well as the second cyclist who is recovering.”
As alleged in court documents and statements made on the record, at approximately 8 p.m. on March 19th, 2026, CROSBY drove his SUV at an extremely high rate of speed in the bus-only lane on West 125th Street between Frederick Douglass Boulevard and Adam Clayton Powell Boulevard. He drove into two food delivery workers on bicycles at a high rate of speed. The first cyclist hit the hood of the vehicle before flying into the air. The second cyclist flew straight into the air. Both cyclists landed at least two car lengths away.
28-year-old Zacarias Darly died from blunt force injuries to the head and neck. The 33-year-old cyclist was in critical condition and had to be intubated at the hospital. He suffered head trauma, a broken leg, fractured elbow, and was hospitalized for nine days.
After hitting the cyclists, CROSBY continued driving at a very high rate of speed. He hit a double-parked NYPD vehicle and lodged his car under a semi-truck.
After CROSBY was apprehended on the scene, officers recovered PCP from him.
