Impact of New York State Discovery Laws on Victims

In 2019, the legislature made necessary reforms to the New York State Discovery Laws. While significant reforms were made, there have been unintended consequences resulting in a 48% increase in the rate of case dismissals citywide including cases of domestic and sexual violence. “As alleged, Agustin Diaz purposefully targeted Spanish-speaking women who were new to the United States and in desperate need of employment,” said District Attorney Bragg. “He allegedly lured them to isolated locations with promises of work, only to sexually assault them in a pattern he repeated with at least four survivors.
